State of Louisiana v. LeBlanc, 22nd JDC, Parish of St. Tammany, Post Conviction-2015
Mr. LeBlanc was serving an illegal life sentence as a multiple felony offender, despite the fact that Louisiana law at the time of his conviction specified he should be serving no more than 10 years. After working on his case for several years, the Louisiana Supreme Court recognized this error, vacated his life sentence in January of 2015, and remanded for resentencing to no more than 10 years.
State of Louisiana v. Ward, 24th JDC, Parish of Jefferson, Jury Trial-2011
Mr. Ward was charged with one count of armed robbery after being seen at scene of an armed robbery in Jefferson Parish. At trial, the jury agreed with the defense argument that Mr. Ward had simply been in the wrong place at the wrong time and Mr. Ward was found not guilty.
State of Louisiana v. Kenney, Louisiana Fourth Circuit Court of Appeal, Parish of Orleans, Direct Appeal-2013
Mr. Kenney was originally convicted of vehicular homicide at trial in New Orleans despite the fact that the state had failed to prove intoxication or the fact that Mr. Kenney was at fault in the accident. On appeal the Louisiana Fourth Circuit agreed that the state had failed to meet its burden of proof and Mr. Kenney’s conviction was overturned.
State Of Louisiana v. Stanton, 24th JDC, Parish of Jefferson, Judge Trial-2012
Mr. Stanton was originally charged with a DWI 3rdOffense. At trial defense expert testimony on toxicology results and pharmacology established that the state’s evidence failed to prove intoxication and Mr. Stanton was found not guilty of a DWI.
State of Louisiana v. Kinsel, 24th JDC, Parish of Jefferson, Post Conviction-2011
Mr. Kinsel was convicted for the aggravated rape of his girflfriend's minor child in 1999. When the minor child turned 18, she came forward and recanted her trial testimony, even under threat of perjury charges. The trial court hearing the case overturned Mr. Kinsel's conviction, but that conviction was later reinstated by an Appellate Court. Despite the fact that the accuser in this case has recanted all allegations, Mr. Kinsel remains in jail, in large part because the federal court could not address state law claims. "It is beyond regrettable that a possibly innocent man will not receive a new trial in the face of the preposterously unreliable testimony of the victim and sole eyewitness to the crime for which he was convicted. But our hands are tied by the AEDPA [Antiterrorism and Effective Death Penalty Act], preventing our review of Kinsel's attack on his Louisiana postconviction proceedings, so we dutifully dismiss his claim." United States Fifth Circuit Court of Appeals, July 19, 2011.
State of Louisiana v. Viera, 24th JDC, Parish of Jefferson, Trial avoided through Negotiated Plea-2015
Mr. Viera was indicted in 2008 for 10 counts involving sexual allegations with 5 victims, occuring in 1995-2000. On the eve of trial, a plea was negotiated that was acceptable to both the victims in this case, and permitted Mr. Viera to avoid a mandatory life sentence.
State of Louisiana v. Wallace, 24th JDC, Parish of Jefferson, Jury Trial-2012
Mr. Wallace was charged with two counts of possession of handgun while in commission of aggravated assault with a firearm and was facing 5 to up to 20 years in prison. At the conclusion of a jury trial client was acquitted as to count 1, found guilty of lesser charge on count 2, and received 90 days credit for time served.
State of Louisiana v. Burt, Criminal District Court, Parish of Orleans, Post Conviction-2008
Mr. Burt was convicted at trial of forcible rape and sexual battery. Following an evidentiary hearing on post-conviction, the trial court reversed the conviction based on Ineffective Assistance of Trial Counsel.
State v. Willis, 24th JDC, Parish of Jefferson, Jury Trial-2013
Mr. Willis was charged with sexual battery of a child under 13. At the conclusion of a jury trial the jury agreed that the child accuser had been coached to make a false accusation and the client was found not guilty.
