In direct appeal, a defendant challenges his conviction for errors that occurred at the trial court level. In Louisiana most criminal cases begin with review at the circuit court level, of which there are five. Such review includes, but is not limited to, error in the trial court's application of the law, unreasonable findings of fact by the trial court or jury, and/or misconduct in the trial proceedings.
Post-conviction relief is a collateral challenge to a judgment of conviction that has otherwise become final in the normal appellate review process. Petitions for post-conviction relief are filed with the trial court, and can include constitutional violations at trial, procedural errors at trial, ineffective assistance of counsel, and/or the discovery of new, exculpatory evidence. Post-conviction relief is governed by both Federal and Louisiana state laws.
Habeas corpus is the collateral review of criminal convictions by federal courts to determine whether a prisoner is legally in custody under federal law. This review can include both state and federal convictions.
